Data Protection Statement

For berlinovo protection of your private sphere is of the utmost importance. For this reason, we comply precisely with the statutory regulations on data protection when collecting and using your data. It is also important to us to inform you here exactly about the use and storage of your data on this website.

1. In General

Person-specific data, according to article 4, no. 1 of DSGVO [Basic Regulation on Data Protection], is all information that relates to an identified or identifiable natural person. A natural person is seen as being identifiable if, directly or indirectly, he or she can be identified particularly by means of association with an identifying factor such as a name, an identity number, location data, an online identification or with one or more special characteristics that are an expression of the physical, physiological, genetic, mental, economic, cultural or social identity of this natural person.

Except where otherwise indicated in the following passages, in principle no person-specific data is collected, processed or used in connection with the utilization of our websites. On calling up our websites some information is transferred, e.g. IP-address, type and version of the web browser used, the operating system used, the website from which you have come and the time of your visit.

This data cannot be used by us to identify the individual users. The information is evaluated by us purely statistically and is used only to improve the attractiveness, content and functionality of our websites.

2. Collection and Processing of Person-Specific Data

Person-specific data is only recorded by us if you disclose this to us and if it is necessary for making use of our services. For example, we collect person-specific data if you want to rent/buy an apartment / a business from us or if you apply for a job or for training with us. If you contact us using our contact forms this takes place via coded connection. If you send us an e-mail via the envelope icon, this is uncoded.

Person-specific data transferred to us in this way is, of course, used by us solely for the purpose for which you disclose it to us at the time of contact. No farther-reaching use is made without your explicit consent.

3. No Transfer of Data to a Third Party

No data is transferred to a third party unless we are legally obliged to do so. To the extent that external service companies come into contact with your person-specific data, we have legal, technical and organizational measures, and regular controls, to ensure that they observe the regulations of the data protection laws.

4. Tenants and Potential Tenants

4.1 Contact Enquiries

If you want to know more about our lease properties or if you are already a tenant and have questions about the existing lease relationship, you can use the contact field or can contact the tenant service. The transfer of data takes place via a coded connection. We then use your data to contact you.

Where we ask on our contact form for details that are not absolutely necessary for the purpose of processing your enquiry, these are marked as optional. Optional details help us to further specify your enquiry and to improve our handling of it. Disclosures of such details are explicitly made on a voluntary basis and with your consent , Art. 6 Abs. 1 a DSGVO. Where these details have to do with channels of communication (such as e-mail address, or telephone number) you also consent to our contacting you via this channel of communication, to answer your enquiry.

You can, of course, revoke your declaration of consent at any time with effect as to the future. To this end please contact our data-protection appointee, whose contact data can be found below.

We will delete the data arising in this context after storage is no longer necessary or will restrict processing if there are record preservation duties prescribed by law.

4.2 Tenant Account

As a tenant you will be given access by us to your personal tenant account. Here you will find your incidental expenses statement. You can call up this statement at any time, provided you have identified yourself by means of your tenant number and the input of a PIN code. The transfer of the data takes place via a coded connection.

4.3 Apartment

Via our website you can, as an employee, or even as a business for your employees, submit the documents necessary for the rental of an apartment. The transfer of the data takes place via a coded connection.

If, in this way, we come to learn of person-specific data, this will be deleted, should no contract be concluded. You can enquire about the availability of the apartment in advance, by telephone, e-mail, by post, or directly in the letting office. For rental purposes we need various details from you that will, of course, only be used for processing of the lease relationship.

5. Career and Training

You send us your application documents preferably by e-mail. Your application documents contain person-specific data of yours.

Please notice that we cannot at present offer any e-mail coding. For this reason we cannot guarantee that your data is protected against access by third parties along the paths of transmission. We are nevertheless working on a solution. As soon as we are able to offer coding we will open our public key here.

Your submitted application documents will be kept safe, during the application process, for establishing contact and for selection of the most suitable candidates. In the event of a successful application, the data given will be used for technical administrative matters for carrying out the employment relationship.

Your application will be examined solely by the relevant contact partners with us (personnel section, management of the relevant specialist section, works council, women's representative, and where applicable, by the disabled persons' representative). All of the employees entrusted with the data processing are obligated to maintain the confidentiality of your data. Under no circumstances are third parties given any information on your disclosures. The processing of the data takes place exclusively in Germany.If we are unable to offer you employment, we will store the data transmitted by you for a maximum period of six months as of the time of the refusal, and we will subsequently delete it securely. 6. Newsletter

With your consent pursuant to Art. 6 Sect. 1 a DSGVO you can subscribe to our newsletter in which we inform you of our latest offers. 

For subscription to our newsletter we use the “double opt-in procedure”. That means that we send you an e-mail to your specified e-mail address after you subscribe, in which we ask you to confirm that you request the sending of the newsletter. If you fail to confirm your subscription within [24 hours], your information will be frozen and deleted automatically after one month.

Beyond this, we store your IP addresses used and time of registration and confirmation. The purpose of the procedure is to prove your registration and where applicable to determine the facts in the case of possible abuse of your personal data.

Only your e-mail address must be specified for sending the newsletter. Specification of other, specially marked data is voluntary and will be used to contact you personally. After your confirmation we will store your e-mail address for the purpose of sending the newsletter. The legal basis is Art. 6 Sect. 1 a DSGVO.

You may revoke your consent to the sending of the newsletter at any time and unsubscribe. You may declare revocation by clicking on the link provided in every newsletter e-mail or by contacting the Data Protection Representative, whose contact data are set out below.

7. Cookies 

For statistical evaluation, we make use of cookies. Cookies are files that can be placed on the hard disk of your computer and that serve to make navigation easier. They avoid the necessity that with every new use, all the necessary data must be input again. Cookies help us to adapt our website to precisely your requirements, e.g. your national language or preferred areas of interest.

This website uses the following types of cookies, whose extent and functioning are explained below:

1.1 Transient Cookies 

These cookies will be deleted automatically when you close the browser. This includes in particular session cookies. They store a “session ID” with which different types of enquiries by your browser can be allocated to the joint session. This allows the identification of your computer when you return to our website. The session cookies will be deleted when you log out or close your browser.

1.2 Persistent Cookies 

These cookies are deleted automatically after a specified period, which may be different depending on the cookie. You can delete the cookies in the security settings of your browser at any time.

1.3 Flash Cookies

The flash cookies used are not recorded by your browser, but through your flash-plug-in. Furthermore, we use HTML5 storage objects which are deposited on your final device. These objects store the necessary data regardless of the browser used by you and do not have an automatic expiration date. If you do not want any processing of the flash cookies, you have to install the corresponding add-on, e.g. “better privacy” for Mozilla Firefox (https://addons.mozilla.org/de/firefox/addon/betterprivacy/) or the Adobe Flash Killer Cookie for Google Chrome. You may prevent the use of HTML5 storage objects by setting your browser to the private mode. We also advise you to manually delete your cookies and the browser cache on a regular basis.

1.4 Blocking Cookies

If you do not want this, you can switch off the acceptance of cookies by your computer. Most browsers accept cookies automatically, but offer the possibility of rejecting cookies or of giving a warning before storing them. For information on how all this functions individually, please read the instructions of your browser manufacturer.

8. Website analysis 

For the purpose of analysis and optimization of our websites we use different services which are presented here below. We may for example analyze how many users visit our site, what information is most sought-after or how the users find the offer. We record inter alia data regarding from which website a party concerned reached another website (“referrers”), which subsites of the website were accessed or how frequently and for what length of time a subsite was looked at. This helps us to make our offers user-friendly and to improve them. The data recorded are not for the purpose of personally identifying individual users. Anonymous/at most pseudonym data are recorded. The legal foundation for this is Art. 6 Sect. 1 f DSGVO. 

9. Data Security

We have taken extensive technical and business-protection measures to protect your data against accidental or intentional manipulation, loss, destruction and access by unauthorized persons. Our security procedures are regularly checked and adapted to account for technological progress.

10. Your Rights

General Rights

Regarding the person-specific data relating to you, you have the following rights with respect to us:

You have a right to information, correction, deletion, restriction of processing, objection against the processing and data transferability. Where processing is based on your consent you have the right to revoke it vis à vis us with effect for the future.

Rights in the case of data processing on the basis of legitimate interest

Pursuant to Art. 21 Sect.1 DSGVO you have the right to lodge an objection at any time on grounds arising from your specific situation against the processing of personal data concerning you which is carried out on the basis of Art. 6 Sect.1 e DSGVO (data processing in the public interest) or on the basis of Article 6 Sect.1 f DSGVO (data processing for safeguarding a legitimate interest); this will also apply to profiling based on this provision. In the case of an objection we will no longer process your personal data unless we can prove grounds for the processing that are worthy of protection, which outweigh your interests, rights and freedoms or the processing is for the purpose of asserting, exercising or defending legal claims.

Rights in the case of direct advertising

To the extent that we process your personal data for direct advertising, you have the right pursuant to Art. 21 Sect. 2 DSGVO to lodge an objection at any time against the processing of the personal data concerning you for the purpose of such advertising; this will also apply to profiling where it is in connection with direct advertising.

In the case of your objection against processing for the purpose of direct advertising we will no longer process your personal data for these purposes

Right to complain to a supervisory authority 

You furthermore have the right to complain to the relevant data protection supervisory authority about our processing of your person-specific data.
