Privacy policy

The protection of your privacy is of maximum importance for berlinovo. Therefore, when collecting and using your data we precisely comply with the statutory provisions relating to data protection. In addition, it is important for us at this point to provide you with precise information on the use and storage of your data on this website.

1. General information

Pursuant to Art. 4 No. 1 GDPR personal data is all information, which refers to an identified or identifiable natural person; a natural person is seen as identifiable, who can be identified directly or indirectly, in particular by means of an allocation to an identifier such as a name, a code number, location data, an online identifier or to one or more special features, which are an expression of the physical, physiological, genetic, mental, financial, cultural or social identity of this natural person.

Insofar as not otherwise presented in the following sections when using our websites principally no personal data are collected, processed or used. When you access our website, some information is transmitted, such as IP address, type and version of the web browser used, the operating system used, the website from which you came and the time of the request.

These data cannot be used by us to identify the individual user. The information is merely evaluated by us for statistical purposes and exclusively used to improve the attractiveness, contents and functionalities of our websites.

2. Collection and processing of personal data

Personal data are only collected by us if you communicate these to us voluntarily and if this is necessary for using our services. We collect, for example, personal data if you would like to rent/buy an apartment/a trade from us or if you apply for a job or an apprenticeship place in our company. If you contact us via our contact forms, this is done via an encrypted connection. If you send us an email via the envelope icon, it is unencrypted.

We will, of course, exclusively use the personal data transmitted to us in this manner for the purpose, for which you make these available when contacting us. A use beyond this will not take place without your explicit consent.

3. No data transmission to third parties
Your data will not be transmitted to third parties, unless we are obligated to do so by law. Insofar as external service providers come into contact with your personal data, we have ensured through legal, technical and organisational measures as well as regular checks that they comply with the provisions of the data protection laws.

4. Tenants and prospective tenants

4.1 Contact request

If you would like to receive more detailed information regarding our rental objects or are already a tenant and have questions regarding an existing tenancy you are welcome to contact us via the contact field or the tenant service. The data will be transmitted via an encrypted connection. We will then use your data in order to contact you for this purpose.

Insofar as we request input via our contact form that is not absolutely necessary for processing your request, we have marked this as optional. Optional details serve to enable us to specify your request and for the improved processing of your concern. These details are explicitly communicated on a voluntary basis and with your consent, Art. 6 Para. 1 a GDPR. Insofar as these concern details relating to communication channels (for example email address, phone number) you additionally consent that we will, if applicable, also contact you via this communication channel in order to reply to your consent.

You can, of course, revoke your consent at any time with effect for the future. Please contact our data protection officer for this purpose, the contact data of whom you can please find below.

We delete the data accruing in this context after storage is no longer necessary or restrict processing if there are statutory retention obligations.

4.2 Tenant account

As a tenant you will receive access from us to your personal tenant account. We have deposited your incidental costs settlement here. You can view your settlement at any time insofar as you have identified yourself through your tenant number and by entering a PIN code. The data is transmitted via an encrypted connection.

4.3 Apartment

Via our website you can as an employee, or also as a company for your employees, submit the documents that are required for the rental or an apartment. The data is transmitted via an encrypted connection.

If we gain knowledge of personal data, this way these will be erased if no contract is concluded. You can ask about the availability of the apartments in advance by phone, email, by post or in the rental office. For the rental we require from you various details, which of course will only be processed for processing the tenancy.

5. Career and training

You send us your application documents preferably by email. Your application documents contain personal data about you.

Please note that we currently do not offer any email encryption yet. Therefore, we cannot guarantee that your data are protected against access by third parties on the transmission channel. We are however working on a solution. As soon as we can offer an encryption, we will publish our public key in this place.

Your submitted application documents will be kept during the application process for the purpose of contacting you and selecting the most suitable candidates. In case of a successful application the provided data will be used for management-technical matters for the implementation of the employment relationship.

Your application will exclusively be available for the knowledge of the relevant contacts (Human Resources sector, head of the relevant specialist sectors, works council, women’s representation, if applicable, representation of seriously disabled) in our company. All employees entrusted with the data processing are obliged to maintain the confidentiality of your data. Third parties will not gain knowledge of your details under any circumstances. The processing of the data takes place exclusively in Germany.

If we are unable to offer you employment, we will store the data you submit for a maximum period of six months from the date of rejection and then securely erase it.

The legal basis is Art. 6 Para. 1 a, b and f GDPR as well as Section 26 German Federal Data Protection Act [Bundesdatenschutzgesetz - BDSG].

6. Newsletter

With your consent according to Art. 6 Para. 1 a GDPR you can subscribe to our newsletter, with which we inform you about our current offers.

For the registration to our newsletter, we use the so-called Double-opt-in-procedure. This means that after your registration we will send you an email to the entered email address, in which we request you for confirmation that you wish the sending of the newsletter.

In addition, we store your respective IP addresses used and times of registration and confirmation. The purpose of the procedure is to prove your registration and, if applicable, to be able to clarify possible misuse of your personal data.

The mandatory detail for the sending of the newsletter is solely your email address. The entry of further, separately marked, data is voluntary and will be used in order to be able to contact you personally. After your confirmation, we store your email address for the purpose of sending you the newsletter. The legal basis is Art. 6 Para. 1 a GDPR.

You can revoke your consent to the sending of the newsletter at any time and cancel the newsletter. You can declare the revocation by clicking on the link provided in each newsletter email or by a contact request to the data protection officer, the contact data of whom you can please find below.

7 Cookies

We use cookies for the statistical evaluation. Cookies are files that can be stored on your computer's hard drive and serve to facilitate navigation. They prevent you from having to re-enter all the necessary data each time you use the site. Cookies help us to tailor our website precisely to your needs, such as your national language or preferred areas of interest.

This website uses the following types of cookies, the scope and functionality of which are explained below:

7.1 Transient cookies

These cookies will be deleted automatically when you close the browser. These in particular include the Session-Cookies. These store a so-called Session-ID, with which various requests of your browser can be allocated to the joint session. This allows your computer to be recognised when you return to our website. The Session-Cookies will be deleted when you log-out or close the browser.

7.2 Persistent cookies

These cookies are deleted automatically after a stipulated duration, which may differ depending on the cookie. You can delete the cookies in the security settings of your browser at any time.

7.3 Flash cookies

The Flash cookies used are not collected by your browser, but by your Flash plug-in. Furthermore, we use HTML5 storage objects that are stored on your terminal device. These objects store the required data independently of the browser you are using and have no automatic expiry date. If you do not want Flash cookies to be processed, you must install an appropriate add-on, e.g. "Better Privacy" for Mozilla Firefox (https://addons.mozilla.org/de/firefox/addon/betterprivacy/) or the Adobe Flash Killer Cookie for Google Chrome. 7.4 Prevention of cookies

If you do not wish this, you only need to switch off the acceptance of cookies in your browser. Most browsers accept cookies automatically but offer the option of rejecting cookies or displaying a warning before storing them. Please refer to the instructions of your browser manufacturer to find out how all this works in detail.

We would like to point out to you that it is possible that you may then not be able to use all functions of this website.

8. Website analysis

For purposes of the analysis and optimisation of our websites we use various services, which are presented below. This way we can e.g. analyse how many users visit our site, which information is most in demand or how users find the offer. We collect, among others, data regarding from which website a data subject came to a website (so-called Referrer), auf which sub-pages of the website was accessed or how often and for which dwell time a sub-page was viewed. This helps us to design and improve our offers in a user-friendly way. The data collected thereby does not serve to personally identify individual users. Anonymous or, at the most, pseudonymised data are collected. The legal basis for this is Art. 6 Para. 1 f GDPR.

Facebook

berlinovo can with the help of the function Facebook Insight, which Facebook makes available as a non-indispensable part of the usage relationship free of charge, receive anonymised statistical data relating to the users of these sites. These data are collected by using cookies. The user code, which can be linked with the registration data of such users, who are registered with Facebook, will be collected and processed when the fan pages are called up.

The data processing by Facebook essentially functions so that Facebook places cookies on the computer or each other device of the persons, who visits the fan page, which aims at storing information in the web browsers and will remain effective for the duration of two years, insofar as they are not deleted.

Facebook receives, records and processes information stored in cookies, particularly when a person visits the site. In addition, other entities such as Facebook partners or even third parties on Facebook services may use cookies that collect user data.

The purpose of Facebook is, on the one hand, to improve the system of advertising, which it distributes through its network.

On the other hand, the data processing should enable Berlinovo, for the purpose of controlling the marketing of its activity, to receive statistics, which Facebook creates based on the visits to this site. The statistics enable the knowledge of various characteristics of the visitors, e.g. age, place of residence, gender. This allows more relevant content to be provided and functions to be developed accordingly.

The cookies will also be placed if the visitor to the site does not have any own Facebook account.

9. Data security

We have taken extensive technical and operational precautions to protect your data from accidental or intentional manipulation, loss, destruction or access by unauthorised persons. Our security processes are checked regularly and adjusted to the technological progress.

10. Your rights

You have the following rights towards us with regard to the personal data relating to you:

General rights

You have a right to information, rectification, erasure, restriction of the processing, to object to the processing and to data portability. Insofar as processing is based on your consent you have the right to revoke this towards us with effect for the future.

Rights with the data processing according to the legitimate interest
Pursuant to Art. 21 Para. 1 GDPR you have the right, for reasons which arise from your particular situation to file an objection at any time to the processing of personal data relating to you, which is carried out owing to Art. 6 Para. 1 e GDPR (Data processing in the public interest) or owing to Art. 6 Para. 1 f GDPR (Data processing for safeguarding a legitimate interest), which shall also apply to profiling supported on this regulation. In the event of your objection, we will no longer process your personal data, unless we can prove essential reasons worthy of protection for the processing, which outweigh your interests, rights and freedom, or the processing serves to assert, exercise or defend legal claims.

Rights in the case of direct advertising

If we process your personal data for the purpose of direct marketing, you have the right pursuant to Art. 21 Para. 2 GDPR to object at any time to the processing of personal data concerning you for the purpose of such marketing; this also applies to profiling, insofar as it is related to such direct marketing.

Right to complain to a supervisory authority
